Three men are claiming that they were passengers in the SUV driven by Lindsay Lohan on the morning of her arrest – telling TMZ.com that the actress had been drinking, and that she commandeered their vehicle to chase after her assistant.

Lohan’s publicist and her attorney did not immediately return PEOPLE’s call for comment on the report.

Before Lohan was arrested early Tuesday morning, the actress had spent the evening drinking at a party in Malibu, one passenger, Dante Nigro alleged to TMZ. Asked if he saw her drinking, he replied: “Yes I did. I saw her walking around with a cocktail, and five or six of us, give or take a couple, took a shot together.”

Nigro and his friends, Jakon Sutter and Ronnie Blake – who say they’re friends with the boyfriend of Lohan’s assistant, Tarin Graham – claim that Graham and Lohan got into an argument, and Graham then quit. When Graham climbed into her car, Lohan jumped into the driver’s seat of Nigro’s GMC Denali (the keys were in the ignition) and chased after her.

Nigro was in the passenger seat trying to grab the steering wheel, and Sutter and Blake were in the back as Lohan proceeded to chase after her assistant, they claim. (Police on Thursday released audio of the 911 call from Graham’s mother, Michelle Peck.)

Nigro says he tried to warn Lohan that she could get into trouble. Lohan’s answer? “I’m a celebrity. I’m not going to get into trouble,” he says was Lohan’s response.

The actress gave birth to a healthy baby boy at a Los Angeles hospital yesterday (07.26.07).

Mother and baby, who weighed 8lbs 4oz, are both said to be doing well.

The couple have named the new arrival Alexander “Kong” Pete Schreiber. The tot was almost two weeks early and friends say Naomi was determined to have a natural labour.

Paris Hilton reportedly smoked weed during a night with Mischa Barton’s ex-boyfriend Cisco Adler at a Hollywood nightclub.

The blonde heiress and Adler arrived at Guy’s nightclub at 1am on Tuesday night (24.07.07), where they were apparently seen hugging and “making out” as they reportedly smoked the drug, according to America’s US Weekly magazine.

Paris took sips from Adler’s drinks before performing a karaoke version of ‘Bette Davis Eyes’ to help celebrate a friend’s birthday.

Fellow revellers also claim Paris sang along to the 4 Non Blondes song ‘What’s Up’, replacing the “what’s going on” chorus with “let’s smoke a bowl!” (NICE, I would have sung Lets smoke a Bong)

Paris and Cisco left the club at 2.30am in separate cars.

Paris’ representative denies she smoked any drugs, but admitted: “She was with Cisco Tuesday night/Wednesday morning.” (Is weed really a drug in the same sense cocaine is a drug, I think not)

Reports of Paris’ drug taking come just a month after the 26-year-old told US chat show host Larry King she had never experimented with drugs.

Nicole Richie appeared in court today to face charges for her wrong-way DUI bust in December — her second DUI conviction in 4 years. A court commissioner sentenced Richie, represented by lawyer Shawn Chapman Holley, to serve four days in the City or County Jail (her choice!) — she got credit for a fifth day, for the six hours she served after being busted.

Richie was also fined $2,048, was ordered back to school for 21 days to an alcohol education course and on three years probation.

Richie must report to serve her time by September 28.

The commissioner issued Richie a stern warning, telling her if she she drove drunk again and she actually killed someone she could be charged with murder — not manslaughter. That’s because after her first DUI, Richie agreed that if she drove under the influence and killed someone, she’d be nailed for murder.

The 25-year-old is expected to give birth sometime in January.

A source close to Richie said at today’s sentencing she was “stoic and serious, but not emotional.”

TMZ asks “Is the SCRAM a Sham?” and the LAT sarcastically declares “Yeah hey, that SCRAM bracelet worked really well, didn’t it.

But Radar has learned that the device registered Lindsay’s drinking exactly as it was supposed to. “We’re very confident that it was working properly,” says SCRAM spokesperson Kathleen Brown. “In fact there are a number of diagnostics that ensure it.” But even though the bracelet registered the actress’s drinking, it isn’t designed to transmit that information on the spot. Instead it works in tandem with a modem, which is placed in Lohan’s home. Meaning Linds could have attend the binge drinking party of the century, but as long as she stayed far enough away from the modem, the proper authorities would be none the wiser until (and if) she stumbled home.

Who are these proper authorities? They’re whoever Lindsay and her representatives wanted them to be. Brown notes that Lohan chose to wear the bracelet voluntarily, a gesture adopted by many people arrested for DUI in order to show good faith to the court. Maybe when Lohan returned home and her lawyer or mom was notified that she had been drinking, action would have been taken. Or maybe not. As it turns out, there’s no guarantee of accountability when someone voluntarily wears a SCRAM, there’s only good PR.
