LOS ANGELES (AP) - The busboy who sued Lindsay Lohan alleges in court papers that he has proof the actress had been drinking before she collided with his van in Beverly Hills in October 2005.
Raymundo Ortega, who is seeking $200,000 (euro135,870) in damages, contends Lohan drove her Mercedes-Benz into a van he was driving after she drank alcohol, and that she later tried to escape paparazzi.
The court papers were filed Tuesday.
Lohan, 21, has countersued, saying the California Highway Patrol concluded that Ortega caused the crash by making an illegal U-turn.
Her lawyers were scheduled to ask a judge next month to compel Ortega to prove the actress was drunk. Instead, they filed to cancel the Los Angeles Superior Court hearing, saying Ortega provided responses to their discovery request.
Lohan was 19 at the time of the crash. She recently spent more than a month at a drug and alcohol treatment program in Utah, her third visit to rehab this year.
She served 84 minutes in jail Nov. 15 as part of a plea deal on misdemeanor drunken driving and cocaine possession charges stemming from two arrests that were unrelated to the crash that prompted the lawsuit.
Last week, the celebrity gossip site TMZ.com published what it said was a receipt showing what Lohan and four friends ordered at the Ivy restaurant the afternoon of the crash. The bill includes four Ivy Gimlets, a vodka drink.

Lindsay Lohan ditched snowboarder lover Riley Giles after hooking up with single Oscar-nominated star Heath Ledger, according to reports.
The actress split with Giles - who she met in rehab - last week, supposedly so the actress could concentrate on her career.
But Australian magazine ‘NW’ claims she dumped Giles after meeting Ledger in a New York club over Thanksgiving.
The magazine reports: “Lindsay and Heath hit it off straight away. When she left the club she started texting him straight away and they hooked up a few times while she was still in New York. They were meeting late at night for sex. It was purely physical.”
Ledger has been single since splitting from fiancee Michelle Williams in September.

Lindsay Lohan was spotted at the American Red Cross blood services facility in an LA suburb yesterday. The recently rehabbed actress is fulfilling part of her plea deal for her DUI conviction last August. Lindsay was sentenced to a mandatory minimum of four days in jail, with 10 days of community service in lieu of two days in prison. She was also given one day credit of time served from her July arrest, leaving just 24 hours in jail, which she must complete by January. Lindsay arrived at the Red Cross at noon yesterday and left around 7 pm, with a book titled Blood under her arm.

Michael Lohan wants to patch things up with his family.
“Reconciliation and redemption — across the board,” says Lohan, a born-again Christian. “Just all of us getting right with God.”
Lohan’s 21-year-old daughter Lindsay, star of “Mean Girls,” “Freaky Friday” and other films, has said that her father’s behavior and her parents’ divorce have caused her to act out.
Michael and estranged wife Dina Lohan settled their long-simmering divorce in August, months after he left a New York state prison where he served almost two years for drunken driving and other charges.
He reunited with Lindsay in September after a 3½-year estrangement. She had entered a drug and alcohol treatment center the previous month after reaching a plea deal on misdemeanor drunken driving and cocaine charges.
Lohan’s visit to the Cirque Lodge in Utah was her third trip to rehab since January, a frenetic year in which she wrecked a Mercedes-Benz, released the box-office flop “I Know Who Killed Me” and was arrested more than once. She left the center earlier this month.
Does Lohan blame himself for Lindsay’s troubles?
“Absolutely. How can I not? I mean, we lead by example,” Lohan said in an interview Wednesday with AP Television News.
He entered a Christian-based drug and rehabilitation center in West Babylon, N.Y., after he was released from prison in March. Lohan had repeatedly said Lindsay needed the same kind of treatment.
“I made a commitment when I was in there to God and to myself that, when I got out, I was going to do God’s work, and I was going to share with other people what I’ve been through and how God changed my life,” Lohan said.
He is now a spokesman for GodMen, which holds events designed to help Christian men renew their faith.
Lohan said he doesn’t care if people question the sincerity of his religious convictions.

Lindsay Lohan stole new boyfriend snowboarder Riley Giles from his fiancée - according to the girl’s mother.
The 21-year-old actress confirmed reports she is dating the California-based X-Games star earlier this month, after leaving the Cirque Clinic rehab facility in Utah.
But Giles was already engaged to Utah resident Bree Tierney - and news of his relationship with the Mean Girls star has left her heartbroken.
Tierney’s mother, Tess, says: “Riley just stopped calling Bree and never told her about Lindsay.
“She found out by seeing photos. It destroyed her.”

Lindsay Lohan has blamed her parents’ separation for her wild behaviour.
The actress, who checked into a Utah rehab facility in August, recently reunited with her father Michael after more than three years of estrangement.
And the tearful get together at her temporary Cirque Lodge home made Lohan realise how important family is.
The wildchild, who spent the first half of 2007 caught up in drink-driving and drug possession legal woes, tells In Touch Weekly magazine: “I think it was really important for me to get a connection back with my dad because I hadn’t had that in a while.
“I can relate to other people who don’t have both parents or have parents that are separated. It can be hard and draining on the children and the family.
“I think the trouble in my family resulted in me rebelling and doing things to try to get my parents’ attention. But all in all, it’s better for me now to have them (in my life). It’s healthy.”
Lindsay has no right to blame her parents. She is old enough to know not to do stupid stuff and she has to pay the consequences.

Lindsay Lohan has checked out of the exclusive Cirque Lodge Treatment Center in Utah, where she has been since August, multiple sources, including both of her parents, confirm to PEOPLE.
“She’s finished the program,” one source says. “Lindsay is done, but she may come back for outpatient treatment. She over-extended her stay because she wanted to. She could have been out awhile ago, but she chose to stay.”
Lohan’s mother, Dina, told PEOPLE Friday: “I’m proud of her. She’s moving ahead with her life. Things were getting out of control. She took action. She took responsibility. She really needed to heal.”
Lohan was photographed Friday afternoon with her father Michael, who carried her suitcases, leaving Cirque Lodge. “I will be there in her life as best I can but from here on she’s going to have a lot of decisions to make on her own,” Michael told PEOPLE Friday. “Now that she is going out into the world, I can only hope for the best.”
The father and daughter reunited last month for the first time in three years when he paid a visit to her in rehab. “I’m enjoying my time with Lindsay and I’m happy to see and believe she’s the Lindsay I last saw three years ago, before all this turmoil came into her life,” says Michael. “I am trying my best to lead by example and institute important tools.”
Of the actress’s reunion with her father, Lohan’s mom, Dina, told PEOPLE recently: “It can only help her recovery. It’s time to mend.”

And Lohan is already gearing up for her return to work: A source says she has plans to start filming her tango-themed movie, Dare to Love Me, in Los Angeles on Oct. 15. Plus, says the source, despite reports suggesting Lindsay is an insurance liability for film studios, Lohan has been insured for this film.
“Lindsay will start her life over,” says the source. “She’s gotten rid of the people around her who were bad influences.”
DUI Arrest
Lohan’s treatment there began in the weeks following her early morning July 24 arrest in Santa Monica, Calif., on suspicion of drunken driving after a brief car chase.
At the police station, Lohan, 21, was searched and a “small” amount of cocaine was found in her pocket, said Santa Monica police spokesman Lt. Alex Padilla.
Immediately after she was booked, her attorney said that Lohan, who had recently completed a six-week stint at Promises rehab center, had “relapsed” and was receiving “medical care.”
A month later, at the time her lawyer negotiated a plea deal for Lohan in her DUI cases, the actress issued a statement in which she accepted responsibility for her actions and said she suffers from drug and alcohol addiction.
“It is clear to me that my life has become completely unmanageable because I am addicted to alcohol and drugs,” her statement said.

For her first overnight visit out of the Cirque Lodge treatment center, Lindsay Lohan is spending five days with her dad, Michael Lohan. Lindsay and Michael had been estranged for three years but reunited for the first time last month, when Michael visited Lindsay in rehab. On Monday, the father-daughter duo headed to a rustic, secluded four-bedroom house in the Utah hills, where Michael wants to hike mountain trails with Lindsay. “It will be just us spending quality time together,” he told E! Online. “Though I know she wants to do some shopping. She’s already told me that!”

Lindsay Lohan is responsible for breaking up a British heiress’ marriage - after the actress slept with her husband in rehab, according to reports.
The 21-year-old star was linked with musician and father of two Tony Allen, 40, earlier this month, following a spell in the Cirque Lodge rehab facility in Utah this summer.
Despite claims from Allen the pair are “just friends”, Allen’s wife Stephanie is claimed to have thrown him out of the couple’s family home in Savannah, Georgia.
A source tells British newspaper the Daily Mirror: “She has had it. They tried forever to have kids. She went through IVF (in vitro fertilization) three times and suffered two miscarriages, and when they finally got two beautiful babies, he hooks up in rehab with a girl half his age.”
The source adds, “He is trying to live out this rock star fantasy at 40. All Stephanie wanted was for him to be a good husband and father.”

Troubled star Lindsay Lohan has vowed to quit Hollywood in a bid to stay clean from drugs, according to her father.
Michael Lohan reunited with his daughter earlier this month in Utah, where the Mean Girls star is seeking counselling at the Cirque Lodge treatment centre.
He says: “When we finally came face to face we just clung on to each other and did not stop crying for at least half an hour.
“Lindsay said:, ‘Daddy, I have done some terrible things and been addicted to drugs but please believe me I will never do drugs again. I hate Hollywood and I don’t want to work there. I need a break and I am moving away. I will stop hanging around with the people that are bad for me.’
“She said she does not want to live in Hollywood as that is where the evil in her life happens.”
The pair haven’t seen each other since Michael went to prison in New York after he was found guilty of driving while intoxicated and other charges two years ago.
