The former “Simple Lifer” obtained a court order blocking the “predatory” paparazzo from coming anywhere near the family—most importantly daughter Harlow’s Los Angeles-area preschool.

And she even turned the tables on the so-called stalkerazzo in her court docs.

Included as an exhibit in her filing is a photo of the shutterbug, identified as one Fabricio Luis Mariotto, standing outside Harlow’s school armed with his long lens.

“Mariotto drives eratically around my children and others, yells, screams and attempts to scare us so that he can photograph our reaction. He trespasses on preschool property to photograph the children,” Nicole states in the court docs.

“He has often left his car in the middle of a busy street just to chase me for a photograph.

“His predatory behavior caused and continues to cause severe emotional distress as I fear for the safety of my children.”

Per the terms of the temporary restraining order, Mariotto must keep 100 yeards away from the preschool, as well as the entire family: Richie, nearly 3-year-old Harlow, year-old Sparrow and baby daddy Joel Madden.

Last month, Richie took to her blog to blast the photographers stationed outside Harlow’s school, vowing to do a background check on every photog she spotted there.

“Now the entire world can see how creepy and disgusting you are,” she wrote. “These are strangers, grown men, stalking young children. You think that’s ok?”

She means business.

“Yep. i’m engaged. Very happy. Yeah we’ve been engaged for a while so your all kind of late on that. But Thanks for the hooplah all the same,” Madden Tweeted Monday night, after news of their plans to wed went wide. He also expressed thanks to relatives who did not let word of the engagement slip.

He Tweeted: “P.s. thats why i love my family and friends. None of them are sources. All good tight lipped people who let us enjoy it! Thanks everybody.”

Richie said Monday night during a taping of the “Late Show with David Letterman” that the couple are engaged to be married, a source told PEOPLE.

After the show, Richie headed to the New York restaurant Abe & Arthurs — without her fiancé — for dinner. “She was glowing,” says a source. “She was telling her table how happy she was.”

Richie, 28, and Madden, 30, began dating in December 2006 and have daughter Harlow, 2, and son Sparrow, 5 months.

And while they’ve been living as a close-knit family, as recently as October Richie dashed engagement rumors. “One day I would love to get married,” she said. “It’s not something we’re talking about right now. If my kids ask me to get married, I’d get married.

All were in play today in downtown L.A., but it’s not exactly what you think.

Richie appeared Monday afternoon in court, where she was granted a permanent protective order against a couple of shutterbugs she had accused of harassing her.

Richie, dressed in a sheer white blouse with her hair pulled tightly back in a bun, showed up with Madden, dressed in a black suit, and gave testimony of a car accident she blamed on the the paparazzi.

But the news that caused the most buzz was her lawyer’s pronouncement of them as husband and wife.

Attorney Mark Geragos repeatedly referred to Madden as “your husband” during questioning of Richie.

And that was news to us.

While Richie and Madden have been together for three years and have two young children, they have not, as far as we know, tied the knot.

There is also no marriage license on file in L.A. County for the duo as of last week.

Afterward, Geragos explained himself. He exclusively told E! News that Richie and Madden have a “common-law” marriage. Richie and Madden, who were standing next to Geragos, didn’t say otherwise.

However, a source close to the couple insisted to E! News that Geragos just misspoke and they aren’t hitched in any sense of the word. (Besides, says family attorney Neal Hersh, the state of California doesn’t recognize common-law marriage.)

As for today’s hearing, Richie faced off with the two photogs, Eduardo Arrivabene and Ivon Emilio Melo Miguel, who she claims hounded her into a car accident last month.

Before Richie took the stand, Geragos prefaced her testimony by telling the court, “She’s not feeling well. She’s been diagnosed by a doctor.”

Richie, who was suffering from the flu last week and ended up missing the launch of her House of Harlow line at Bebe, coughed the entire time as her lawyers offered her water.

During her testimony, Richie detailed the events leading up to the car accident.

“A few of the paparazzi had become more aggressive…trying to get in front of me, trying to get beside me, ran a red light,” said Richie. “I was hysterically crying.”

Richie told the court, “They’re always following me. I’ve seen them inside my property once.”

Madden also took the stand saying, “She’s with the kids 24-7, and she takes them to work. She’s constantly terrified.”

Before making a decision, Judge Carol Goodson said, “The court is extremely concerned about the possibility of a future accident,” then added, “but you’re asking me to weigh the pros and cons of celebrity…They do have a right to earn a living…[Richie] does not have a right to pick and choose her photographers.”

The photogs, who were also present in court, apologized to Richie and “promised” to leave her alone. Miguel claimed he’s never been on Richie’s property.

The protective order extends to Richie and her two children, Harlow and Sparrow, and will expire Nov. 16, 2012. The paps must stay at least 50 feet away from the family and their vehicle.

Keeping herself busy as she readies for her second child, Nicole Richie was spotted running around Los Angeles over the weekend.

Wearing a casual pink ensemble, the former “Simple Life” starlet dropped by her Pilates class before grabbing a bite to eat at Sharky’s.

And while she’s already been down this path before, insiders tell that Miss Richie has been a bit emotional as of late.

“Her hormones have really been kicking in and Nicole has been crying at everything from movies, to TV shows and even commercials,” a source told press. “Joel [Madden]has been tiptoeing around her making sure he doesn’t upset her – but it doesn’t seem to be working.”

In 7 Things, the Hannah Montana star takes aim at the guy who broke her heart, and she enlisted the help of moviemaker Brett Ratner to help her get her message across in the video.

Cyrus claims writing the song was “a good little therapy moment” for her, admitting “the word hate could describe how angry I was”.

Speaking on Los Angeles Dj Ryan Seacrest’s radio show on Wednesday morning (24Jun08), Cyrus said, “That’s Miley going through, like, 900 emotions while I’m trying to write a song”.

And she hopes the target of the tune – widely believed to be Jonas Brothers star Nick Jonas – is upset enough to call after the promo debuts in America on Saturday night.

She adds, “I wanted them (sic) to be upset. That was my point.

“Maybe after my video we’ll hear from somebody, because it’s pretty honest”.

The couple’s rep said: “The beautiful healthy baby girl left the hospital with her ecstatic parents.”

Currently the new parents have yet to set a wedding date but have decided to put their baby first.

Nicole Richie and Joel Madden have taken a philanthropic turn as they wait for the arrival of their first baby. The couple launched the Richie-Madden Children’s Foundation by hosting a surprise baby shower on Monday for 100 expectant and new moms at the Los Angeles Free Clinic in Hollywood. The generous pair handed out more than $200,000 worth of gifts, including Baby Björn products, cribs, mattresses and toys from Fisher-Price. “Everything they got, we got,” said Nicole. “So everything that will be in their nursery, will be in our nursery.” As for what made them take a page from the Brangelina book? “We grew up in Los Angeles,” said Joel, “and we want our child to be a part of the community and to know that there’s a responsibility to help the community.”

Nicole Richie is using her Wizard of Oz-themed baby shower to benefit charity.

The Simple Life star and boyfriend Joel Madden, who are due to have their first child in January, will donate baby gifts to 100 expectant families in need through the newly-formed Richie Madden Foundation through the Los Angeles Free Clinic.

“It’s really sweet,” says shower guest Rashida Jones, of NBC’s The Office. “With all the swag these days, we’re given so much stuff it’s almost wasteful, and it’s kind of nice when we’re giving to each other to give to someone else.”

While many friends at Sunday’s shower in Beverly Hills donated gifts to the charity, they also brought gifts for Nicole and Joel to keep – including one children’s book from every guest to help build the baby’s library.

It is nice to see celebrities do something good with their gifts.

Nicole Richie and Joel Madden recently made an offer on a home in a gated Southern California community only to be denied by their potential neighbors, a source tells Us Weekly.

When the mom-to-be heard that she and fiance Madden were denied by residents who were conerned about photographers hovering near their homes, “Nicole was livid because she loved the house,” the source says. “She thinks it’s a BS reason, but she couldn’t fight it.”

Still, being dismissed hasn’t put a damper on the couple’s growing excitement over their coming event. Another source tells Us that Richie, 26, is planning a baby shower for the end of November. And Madden, 28, expects fatherhood to have a positive impact on many parts of his life, including his songwriting. “I’m sure it will inspire me,” he told Us on October 27. “Yeah, I’m sure it will.”
