“It’s been a long ordeal of almost four years,” Dr. Sandeep Kapoor, a 42-year-old internist, said during an exclusive interview on TODAY. “It’s just absolute joy and relief, I suppose … I think the jury had all the evidence, which there was a lot of, and really saw there was a legitimate need.

“Anna Nicole Smith suffered chronic pain and several other medical conditions and required treatment,” Kapoor added.

Kapoor was acquitted after 13 days of deliberations, but Smith’s former lawyer/boyfriend, Howard K. Stern, and her psychiatrist, Khristine Eroshevich, did not fare so well. Both were convicted of felony conspiracy for using fake names to get Smith prescriptions for opiates and sedatives and could get as much as three years in prison when sentenced.

The charges against the three were unrelated to Smith’s 2007 overdose death in Florida. Playboy’s 1993 Playmate of the Year was just 39 when she died.

Crossing the line?
The evidence against Kapoor included photographs from a 2005 gay pride parade in West Hollywood in which he marched shirtless alongside Smith and was kissing her. Jurors also were shown passages from Kapoor’s own diary, in which he described “making out” with Smith and wondered whether he’d crossed a professional line with her.

That’s a page taken out of a personal journal of 800 pages,” Kapoor told TODAY co-anchor Meredith Vieira. “That was one afternoon at a charity event that certainly was taken out of context again and blown of proportion … It was a professional relationship with a patient and a doctor.”

Kapoor’s lawyer argued successfully during the trial that the pills Kapoor prescribed for Smith were part of a regimen he inherited from the doctors whose practice he took over. Smith suffered from migraines, spinal pain and other ailments that required pain management treatment, Kapoor said.

He told Vieira that the case only wound up becoming a criminal matter because of the notoriety surrounding Smith, whose life and death at a young age some have likened to Marilyn Monroe’s. Smith’s death spawned investigations in California, Florida and the Bahamas. Her death also touched off a tug-of-war over her remains and a paternity/custody battle between Stern and Larry Birkhead, who eventually was confirmed to be the father of Smith’s daughter, Dannielynn.

“It just happened to be that [Smith] was a public figure and the subject of tabloid fodder,” Kapoor said. “That became a jumping-off point for a lot of the circuslike atmosphere.”

Not out of the woods
Although he was acquitted of all charges, Kapoor isn’t out of the woods yet. He said he will try to rebuild his reputation and practice while waiting to find out what, if anything, a California board that regulates physicians may do concerning his license to practice medicine.

“Certainly there may be a further investigation by the medical board,” said Ellyn Garofalo, Kapoor’s attorney. “We are hoping the medical board will look at these verdicts and understand the evidence in the criminal matter … and forego any further proceedings with Dr. Kapoor.”

Stern and Eroshevich are due back in court in January. Under California law, each could ask the court for a new trial, or to reduce the convictions to misdemeanors.

A judge has set an Aug. 4 start date for Howard K. Stern and two doctors accused of aiding and abetting Anna Nicole Smith’s prescription-drug habit, which ultimately resulted in her death from an accidental overdose in 2007.

After a three-week preliminary hearing in October, Los Angeles Superior Court Judge David Wesley determined that there was enough evidence to merit a trial for Stern, psychiatrist Khristine Eroshevich and Dr. Sandeep Kapoor.

The trio have pleaded not guilty to 23 felony counts altogether, including obtaining an opiate prescription by fraud, deceit or misrepresentation;  prescribing, administering or dispensing a controlled substance to an addict; and unlawfully prescribing a controlled substance.

Another hearing is scheduled for April 23.

Larry Birkhead has purchased a 10,000-sq.-ft., six-bedroom house in his hometown of Louisville, Ky., for himself and 21-month-old daughter Dannielynn, he tells PEOPLE.

Birkhead, 35, says the house, which has 40-ft. ceilings and is modeled after a Sicilian church, was never completed, needs a lot of work, and right now “looks like a haunted house,” but he loves it.

“When I walked in, I said to myself, ‘This is our home!’” says Birkhead.

He adds he might sell the Los Angeles house where he’s surrounded by memories of its former occupants – Dannielynn’s mother, Anna Nicole Smith, and half-brother Daniel, who both died from drug-related complications.

“At first, I couldn’t imagine parting with it,” says Birkhead. “Then I realized I was probably holding on to it for the wrong reasons, thinking to myself that would ease the pain of losing Anna and Daniel. I have always thought that it would be great for Dannielynn to grow up in her mother’s home; however, there is no yard as it is over a canyon.”

He adds: “There also isn’t any little friends for her to run around with – which makes the idea of Kentucky even more inviting.”

In what seemed like forever, Anna Nicole Smith is finally getting buried. TMZ reports on the funeral:

The long awaited and highly disputed funeral of Anna Nicole Smith is officially set for tomorrow, and the former Playboy Playmate is getting to her final resting place in high style. Smith’s body is scheduled to leave the Broward County Medical Examiner’s office with a police escort all the way to Miami International Airport. The coffin will then be transferred to a private plane and flown directly to the Bahamas. Once on the island, another motorcade will transport Smith’s casket to Mount Horeb Church in Nassau.

The doctor who prescribed methadone for an 8 months pregnant Anna Nicole Smith, defends his actions by saying that giving her the drug was “medically sound and appropriate.”
Dr. Sandeep Kapoor’s lawyer goes on to say that it’s a-ok for pregnant women to take methadone, and by the way, who cares if he prescribed it to a pseudonym, because, well, she’s a public figure and has a right to her privacy.

Charlize Theron has been tipped to play Anna Nicole Smith in a film about her life.The actress is movie bosses’ first choice to star as the Playboy Playmate who married an 89-year-old oil billionaire and died aged just 39 last week.

A source revealed: “You couldn’t make up a life story like Anna’s. Studios are falling over themselves to pay tribute to an incredible woman. There are a number of actresses earmarked to play Anna, with Charlize the favourite.”

This won’t be the first time the 31-year-old South African has played a controversial real-life character.

A California judge is clearing the way for Anna Nicole Smith’s body to be buried, but the question remains — to whom will the body be released?

Moments ago, a California judge withdrew his request to put a 10-day hold on Smith’s remains, meaning her body may be released and buried, pending a corresponding ruling from a Florida court. A decision is expected shortly.
